Because the weather in the Las Vegas area is so temperate, residents and visitors can enjoy swimming pools almost year round. But tourism tends to increase during the summer months so swimming pool use tends to increase during this time of the year. Unfortunately, that often means a corresponding jump in swimming pool injuries.

In fact, two tragic hotel pool incidents occurred within two days of each other at swimming pools on Las Vegas hotel properties in broad daylight. On August 22 around 5:45pm, Matthew Williams suffered a head injury in the Rehab Pool area of the Hard Rock Hotel on Paradise Road. The 27-year old Oregon man was transported to Sunrise Medical Center, but was pronounced dead due to his injuries. Authorities are still investigating how Williams sustained the head injury.

Less than 48 hours later, a five-year old girl almost drowned at the pool of the Rio Hotel and Casino on Flamingo Road. At about 2pm on August 24, the unidentified girl (who was staying at the hotel) was rescued from the hotel’s pool and taken immediately to University Medical Center, where she was stabilized. Police are still investigating the circumstances of her accident.

I’ve written at length about swimming pool accidents before but these two incidents illustrate how dangerous swimming pools can be – even ones on the properties of large hotels. No matter where you are, it is important that you exercise extreme caution in and around pools and make sure that children are supervised at all times.

Strollers are a must-have item for parents of young children these days. Las Vegas-area moms and dads who have two young kids (or twins) may opt for a “double stroller,” which is simply a stroller with two seating compartments. Unfortunately, one brand of double stroller could potentially cause injuries to these defenseless toddlers.

About 3,700 such strollers were sold for around $400 each at popular retailers and online portals. The products are manufactured in China and distributed by Oregon-based Lan Enterprises.

According to the CPSC, the frame latches above the front wheels on the strollers have sometimes failed when the stroller hits an object. This can cause the stroller to unexpectedly collapse, which leaves children vulnerable to cuts, scrapes, and bruises. Lan Enterprises has received over 180 reports of frame latch failures on Zooper Tango double strollers.

The model numbers of the recalled strollers are SL808B and SL808F; however, these numbers were only printed on the original packaging of the products. But the dates of manufacture are visible on the warning labels that are attached to the stroller seats. Customers who own the affected Zooper Tango double strollers should stop using them immediately and contact Zooper USA to receive a free repair kit.

We think of hospitals and health care facilities as places we can go where doctors and nurses can cure whatever ails us. However, sometimes a patient’s poor condition can be aggravated during a hospital stay – or that patient may fall victim to an entirely new malady. And it’s not unheard of for patients to die as a result of these new illnesses. Sadly, many of these in-hospital problems are totally preventable.

In the summer of 2010, the Las Vegas Sun newspaper conducted a study of southern Nevada hospitals to determine the incidence of what it called “preventable harm” events such as falls, infections, bedsores, and similar injuries. The study looked at almost three million inpatient records stretching back a decade. When examining the inpatient records for ten hospitals which commonly serve Las Vegas-area patients, the newspaper found:

  • A total of 714 preventable harm incidents
  • 316 infections associated with vascular catheters
  • 194 falls and similar traumas
  • 70 cases of Stage III and IV pressure ulcers (commonly known as bedsores)
  • 46 urinary tract infections associated with catheters
  • 44 cases of deep vein thrombosis or pulmonary embolisms
  • 21 foreign objects that were left after surgical procedures
  • 13 surgical infections

This data can be viewed in two ways. Hospital proponents might argue that these preventable harm events represent a very small percentage of the patients treated at these hospitals. On the other hand, because these events are preventable, they have no business occurring in the first place.

Over three-fourths of child drownings occur in residential swimming pools. However, that means some kids drown in non-residential pools or natural bodies of water. Some examples of these drowning accidents may happen:

  • at a supervised lake swimming area in Clark County
  • in a fast-moving river or stream in or near the mountains
  • in a pool at a recreational vehicle park in Boulder City
  • at a recreational center swimming pool in Summerlin
  • at a water park in Jean

Before you allow your child to enter any swimming pool, lake, or river, you need to assess the level of supervision that is present. Pools at many hotels, resorts, water parks, or rec centers may supply lifeguards to supervise swimmers. Other swimming pools, like those at RV parks and smaller motels, often display signs warning children not to swim unattended. Though these pools will not have any lifeguards present, there should still be access to lifesaving equipment. It is important to note that notification of a lack of lifeguards does not automatically absolve pool owners or operators from liability in cases of drownings or injuries at their pools.

Some natural swimming areas are staffed by lifeguards (such as lakefront beaches or popular swimming holes), but most are not. In some cases, the municipal entity responsible for overseeing these sites can be held liable for child drownings.

The Federal Motor Carrier Safety Administration carefully regulates all trucking companies and their loads to make sure they are safe and secure. But what about trailers being pulled by vehicles driven by private citizens?

When you file a personal injury lawsuit against another person or company, you will likely be entitled to damages if the defendant was completely at fault in an accident.

But what happens if both parties share blame for an accident?

The state of Nevada has fashioned its negligence laws to accommodate these types of situations. It’s called “comparative negligence.” While the actual legislation is complex, here are its two basic tenets:

  • The party who is more to blame for an accident cannot receive damages from the other party.
  • A plaintiff who shares partial blame for an accident will see his or her damages reduced in proportion to the amount of fault.

For instance, if a man were involved in an accident where he sustained $10,000 worth of property and injury damages but was determined by the courts to be 30 percent at fault, he would only receive $7,000 ($10,000 minus 30 percent of $10,000) in compensation from the defendant.

This situation arises more than you might think. Here are some potential scenarios where an injured party might be partially at fault for an accident.

  • A woman driving without her lights on at dusk is rear-ended on a Las Vegas street.
  • At a Green Valley warehouse store, a man walks into an area clearly marked “Authorized Personnel Only” and is injured when pallets of stored merchandise fall on top of him.
  • A teenager riding a skateboard is struck by a car in a Boulder City parking lot which is clearly marked with signs saying “No Skateboarding Allowed.”

Many people in Las Vegas and Clark County own dogs. Lots of these individuals love to take their dogs out with them in public. In a perfect world, all of these dogs would be well-behaved and non-threatening toward people and other animals. Unfortunately, this is not always the case.

That’s why Clark County has enacted a leash law. The ordinance states that all dogs which are not on the premises of their owners must be leashed at all times. Many cities, such as Henderson and North Las Vegas, have leash laws on the books as well. However, dogs are not required to be on leashes in certain designated rural areas of Clark County. In addition, there are some off-leash “dog parks” scattered throughout the greater Las Vegas area where dogs are permitted to run freely.

The idea behind these laws is to reduce the possibility of dog bites, attacks, and dog bite injuries. If a dog is on a leash and under the control of its owner, it is much less likely to break free and attack someone potentially causing facial lacerations, eye injuries, hand injuries, etc.

Of course, the dog’s owner is still liable for any injuries that his or her dog may cause to another person – whether the dog is leashed or not. I’ve talked about electric stun gun injuries (otherwise known as Taser guns) before. These weapons can deliver tens of thousands of volts into the body of a victim. Some victims of Taser guns have reported symptoms and effects long after the incident passed – and some people had even died after being shocked with a Taser.

Many individuals have sued the Taser Corporation alleging that the stun guns are more dangerous than they are reported to be. Company officials have always claimed that the weapons were either used improperly by law enforcement agencies or that the victims had an underlying condition which contributed to their injuries or loss of life. And in the past, the company has gotten away with it.

But that may be about to change.

In Watsonville, California (CA), a man was awarded $2.85 million in a settlement with Taser Corporation related to an anoxic brain injury after he was shocked by a stun gun. As part of the settlement, the company did not admit to causing 49-year-old Steven Butler’s brain injury. But Taser Corporation was unsuccessful in getting the dollar amount of the settlement sealed by the court. This marks the first time that a “price tag” has been attached to a personal injury lawsuit involving Taser guns.

In October 2006, Butler was shocked by a Watsonville police officer using a Taser X-26 after Butler refused to get off of a bus. Butler went into cardiac arrest, and medical personnel needed 18 minutes to revive him. By then, Butler had suffered irreparable brain damage. Today, Butler has no short-term memory, decreased mobility and motor skills, and the need for 24-hour care.

This settlement could potentially be the first of many reached between Taser Corporation and plaintiffs who have sued the company over stun gun use. The Consumer Product Safety Commission issued a recall of a certain brand of baby monitors because some of them have reportedly overheated and started smoking. The recalled product is made by Circus World Displays Limited based in Niagara Falls, Canada. The name of the product is the Levana Wireless Video Baby Monitors with a model number of LV-TW300.

About 800 of these video baby monitors were sold between February and May of 2010 at Health and Safety and BB Buggy retailers in Canada, but Nevadans were able to purchase these products via the Internet.

The problem is reportedly in the camera’s wiring, which is susceptible to overheating and can emit smoke, causing a burning hazard. Anyone who bought these video baby monitors should stop using them and return them to Circus World Displays for a full refund.

A family of five was driving along Interstate 15 (I-15) in Las Vegas when their right tire blew out. In many instances, when this happens, the driver and passengers are inconvenienced since they have to replace the tire or wait until AAA shows up. Unfortunately, this was not the case for the family on I-15.

Their pickup truck traveled across multiple lanes and eventually slammed head-on into a parked paving truck. Both parents were killed and the three children suffered serious injuries, according to fox5vegas.com.

My deepest sympathies go out to the injured children. Their lives will be changed forever after this awful accident. Not only will they need time to recuperate from their injuries, but they’ll now be forced to grow up without their parents; truly heart breaking.

Nevada Highway Troopers wanted to stress the importance of remaining calm when a tire blows out. The best way to avoid an accident is not to panic and keep your vehicle going straight until it can safely come to a complete stop.
