If you’ve ever been to a major European city, you’ve probably seen a traffic roundabout. Instead of traditional crossroad intersections where some traffic must stop before proceeding, roundabouts aim to create a continuous traffic flow by “absorbing” motorists into a circular roadway from which they can exit when they reach their intended outlet.

There are roundabouts in many parts of the U.S. as well, including Las Vegas. But because many Nevadans aren’t used to seeing them, the drivers may get confused when approaching one – and that creates the potential for a traffic accident.

That’s what happened early Thursday morning in Summerlin when a motor bike operator was involved in a single vehicle fatal crash. Metro Police say that the 20-year old man was operating a 2006 Suzuki motorcycle on Flamingo Road near Granite Ridge Drive when he lost control at a roundabout at around 3:25am. The unidentified driver was pronounced dead at the scene. There’s no word on what caused the accident or whether alcohol was involved.

We can only speculate about how this motorcycle accident occurred. Maybe the man didn’t notice the roundabout in the darkness until it was too late. Perhaps there was another vehicle that the motorcyclist swerved to miss which then left the scene of the accident. However it happened, this incident highlights the dangers of roundabouts if you do not navigate them correctly.

Here are some roundabout tips:

  • Decrease your speed before you enter the roundabout.
  • Watch for traffic coming from the left. If you cannot enter the roundabout safely, stop and wait until there is an opening in the traffic flow.
  • If the roundabout is more than one lane, get into the outside lane before you get to your exit street. But be wary of merging traffic if you drive past an entry point while in the outside lane.
  • Try to anticipate other drivers switching lanes in front of you as they try to enter or exit the roundabout.
  • Don’t feel bad about making an extra lap around the roundabout if it means avoiding an accident.

If you have been injured in a motor vehicle accident in a roundabout, you may consider consulting a personal injury lawyer to see about getting compensated for your medical bills.

This weekend, neighborhoods across Las Vegas, Summerlin, Pahrump, Henderson and Boulder City will be invaded by little ghosts, goblins, superheroes, and princesses.

Halloween is supposed to be a day of adventure, excitement, and fun for Nevada children. Unfortunately, with so many youngsters out and about on All Hallow’s Eve, the chances of vehicle-pedestrian accidents skyrocket. In fact, a recent Center for Disease Control Study found that the potential for auto accidents involving children pedestrians increases four-fold on Halloween.

So as a driver, here are some suggestions for keeping Halloween safe for trick-or-treaters:

  • During hours when the kids are trick-or-treating, drive below the speed limit through neighborhoods or populated areas.
  • Pay extra attention to intersections and crosswalks.
  • Keep an eye on the sidewalk, curb, or side of the road for kids who may suddenly step into the roadway.
  • Be wary of kids crossing the street going house to house looking for treats.
  • Do not pass cars that are parked in the roadway. They may be dropping off or picking up trick-or-treaters who may cross the street in front of you.
  • If you are transporting trick-or-treaters, leave your hazard lights on while you are parked.
  • Absolutely do not talk or text on a cell phone while driving during trick or treat hours. If you have to make a call or return a text, pull over.

If your child gets involved in a crosswalk accident on Halloween, seek medical attention immediately. Then contact a personal injury lawyer to see about getting compensation for your youngster’s injuries.

Another Toyota Recall

By Farhan Naqvi, Personal Injury Lawyer in Las Vegas

The past year has been a dreadful one for Toyota Motor Company. The automaker has had to recall about ten million vehicles for various reasons. And last week, the company issued yet another recall of vehicles which bear the Toyota and Lexus brands.

On October 21, Toyota announced that it was recalling about 1.66 million vehicles worldwide due to a brake fluid leak problem in the brake master cylinder seal. Such a leak would trigger the brake warning light on the vehicle’s dashboard to light up. Though Toyota is aware of 14 brake fluid leaks as a result of this problem, there have been no reports of accidents.

Here are the recalled models and their production dates for the vehicles that were sold in the United States:

Toyota Avalon           September 2004 to February 2006

Toyota Highlander    May 2003 to November 2005

Lexus models GS       September 2004 to February 2006

Lexus IS                     May 2005 to March 2006

Lexus RX                   February 2003 to February 2006

The production date of each vehicle can be found on the inside of the driver door.

According to Toyota, leaking brake fluid could cause a gradual decline in the effectiveness of the brakes. Drivers might notice their brakes starting to feel “spongy” when applying the brake pedal. Owners of the affected vehicles should take them to an authorized Toyota service dealer to have the brake master cylinder seal replaced at no charge.

If you have purchased a Toyota vehicle in the past several years, you should make sure that it has not been affected by this recall or any of the others issued by Toyota in recent months. If you feel that your vehicle is defective in some way and that the defect has caused an accident, you should contact a product liability lawyer as soon as possible.

Las Vegas is known for many attractions, including its restaurants. Visitors and residents can choose from fine dining, exotic cuisine, all-you-can-eat buffets, and much more. The vast majority of the time, these establishments take great care in making sure their food is prepared properly and safely. But once in a while, a mistake can happen – which could result in food poisoning for a patron.

Here’s a quick synopsis of the common types of food poisoning:

e.Coli – This bacterium is most prevalent in foods that have not been cooked at the proper temperature for the right length of time. Symptoms, which include abdominal cramps and diarrhea (which may be bloody), often manifest themselves two to eight days after consumption.

Listeriosis – The listeria bacterium can get into all kinds of food via contaminated soil or water. The symptoms generally include fever, nausea, diarrhea, and muscle aches; but can worsen if the bacteria spread to the nervous system.

Salmonella – This bacterium can get passed onto foods from food handlers who fail to properly wash their hands after going to the bathroom. People will begin to see symptoms 12 to 72 hours after contamination, and could experience fever, diarrhea, and abdominal cramps.

Norovirus – This pesky virus can exist on food preparation surfaces and can affect different types of food. Common symptoms are diarrhea, vomiting, nausea, and stomach cramps, and they arise about 24 to 48 hours after infection.

If you experience the symptoms of food poisoning shortly after eating at a Las Vegas restaurant, seek medical attention. If you sustain substantial medical costs as a result, you may want to consider hiring a qualified personal injury attorney to assist you in getting appropriate compensation.

October hasn’t even ended, and there have already been 60 fatal traffic incidents in the Las Vegas Metro Police jurisdiction. The latest occurred early Saturday morning when a man was hit and killed by a car while he was walking across Flamingo Road.

According to the Las Vegas Sun newspaper, 44-year old Peter Callaghan tried to cross the roadway at the Swenson Street intersection against a traffic signal at 3:46am Saturday morning. A 2007 Lincoln Town Car driven by 66-year old Sharon Smith was driving westbound on Flamingo Road with a green light when the vehicle struck Callaghan. He was rushed to University Medical Center, where he was pronounced dead from multiple blunt force injuries.

This incident reinforces what we have all been taught since childhood: don’t cross the street against a traffic light, even when it’s late and you don’t think any cars are around. Not only do you run the risk of being injured or killed, but you also contribute to the cause of the accident – which has ramifications in civil court.

But every case is different. If you or a loved one was involved in a crosswalk accident, consult a qualified crosswalk accident lawyer to get your questions answered about your particular set of circumstances.

October is Sudden Infant Death Syndrome (SIDS) Awareness Month. The motivation behind the event is to promote awareness of SIDS, which is the leading cause of death among infants between the ages of two and four months.

Scientists have not determined the exact cause of SIDS, but they have discovered links to certain risk factors. One of these factors is putting the baby to sleep on his or her stomach or side. That’s why physicians recommend that Las Vegas parents position their infants on their backs when they sleep.

In an effort to prevent SIDS, some companies developed what they called “sleep positioners” which were ostensibly designed to keep babies on their backs while sleeping. Unfortunately, these bolster-like products were reportedly causing suffocation problems for the infants who were using them. As a result, the Consumer Product Safety Commission and the Food and Drug Administration have both recommended that parents avoid these sleep positioning products.

In addition, a lawsuit has been filed against eight manufacturers of these sleep positioners, and it may soon reach class-action status. Plaintiffs allege that the manufacturers have no scientific evidence that these products reduce the chance of SIDS, and that the defendants engaged in fraudulent and deceptive marketing practices to promote them.

The companies listed in the lawsuit are:

  • Baby Delight, Inc.
  • Dex Products, Inc.
  • Kid Brands, Inc. (d/b/a Sassy)
  • Kiwi Holdings, Inc. (d/b/a Basic Comfort)
  • Learning Curve Brands (d/b/a The First Years Company)
  • Munckin, Inc.
  • Prince Lionheart, Inc.
  • Summer Infant, Inc.

If you have purchased one of these sleep positioners for your baby, you should stop using it immediately. If your infant has been hurt by one of these sleep positioners or any type of baby product, you should contact a product liability attorney to see about holding these manufacturers accountable.

If you were tired of sitting in traffic on U.S. 93 driving from Las Vegas to Arizona because of the Hoover Dam bottleneck, then this is a week of celebration for you

Officials recently opened the Mike O’Callaghan-Pat Tillman Memorial Bridge which offers travelers an alternative to crossing the Hoover Dam. At 1,900 feet, it is the longest single-span concrete arch bridge in the Western hemisphere. It is estimated that a vehicle trip from Las Vegas to Phoenix will now be reduced by 30 minutes or more.

The bridge is part of a 4-lane bypass that reroutes traffic away from U.S. 93 for about 3.5 miles. But traffic officials are warning that the bridge may present some challenges for motorists.

  • The speed limit on the bridge is 55 miles an hour. So drivers who are used to driving at higher speeds on nearby highways will have to slow down.
  • Like similar bridges, heavy winds blowing through the canyon can have an effect on the traffic on the bridge. High-profile vehicles like RVs, campers, buses, and tractor-trailers may be blown sideways by high wind gusts, causing the drivers to lose control of those vehicles. (In fact, high-profile vehicles will be prohibited on the bridge if winds are measured at speeds greater than 50 mph.)
  • Because cold winds frequently blow through the canyon under the bridge, the roadway is more likely to be slippery or littered with icy patches during the wintertime. This could result in an increase in car, truck, SUV, and/or motorcycle collisions.

So if you are driving across the Mike O’Callaghan-Pat Tillman Memorial Bridge, be sure to exercise caution. Even if a patch of ice or a gust of wind causes you to lose control and initiate a serious car accident, you are still liable for the damage to other vehicles and the injuries to their occupants.

It’s hard to believe that millions of babies could potentially be at risk because of an everyday product that was distributed by a major company. But that’s exactly what has happened – which means that Clark County parents should take note.

Today, the Consumer Product Safety Commission announced a recall of over two million Graco baby strollers. The Atlanta-based company says infants or toddlers can become trapped or strangled between the trays and the seat bottoms of these strollers.

The voluntary recall affects Chinese-made Graco MetroLite and Quattro Tour strollers that were manufactured before January of 2008. The strollers in question were sold between November of 2000 and December of 2007 at popular retailers for between $100 and $250 each.

There have been ten reports of injuries from children slipping into the gap between the tray and the seat bottom. Four of these incidents resulted in cuts and bruises, while one other infant reportedly experienced breathing difficulties. But the other five injury reports involved baby strangulations.

It is important to note that the potential for injury only occurs when the child is not harnessed into the stroller. Nevertheless, owners of these strollers are being urged to stop using the products at once and to contact Graco for a free repair kit.

This recall highlights the importance of securing your child in a stroller. It only takes a few seconds for a baby or toddler to slip out of a stroller seat if he or she is not harnessed. And even a half-minute lapse in supervision can allow a mobile child to escape and crawl or walk into danger (like off of a sidewalk and into the street).

If your child has been injured due to a defective stroller or other product, consider contacting a product liability attorney who can help you seek compensation for medical bills and other related costs.

Clark County is home to thousands (millions?) of pet owners. Those of us who have a dog, cat, or other animal at home really treasure the things they offer us. These pets are a source of pride and enjoyment, and they give us unconditional love. They enrich our lives in so many ways that we adore and cherish our pets almost as much as we do our children.

Unfortunately, the law doesn’t see pets the way we do. The law classifies animals as simple property.

Therefore, if your pet is hurt or killed by the actions or negligence of someone else, you won’t be able to seek much (if any) monetary relief from the civil court system through some type of personal injury lawsuit. That’s because the law does not take into account all the value that your pet adds to your quality of life. It only views your animal in terms of how much money it is worth (which is usually no more than any price you paid to acquire it).

There may be a few exceptions to this rule. You may find it worthwhile to seek compensation for a pet that was killed or injured if the animal is/was:

  • A working part of your business (like a sheepdog on a farm)
  • A service animal (like a seeing-eyed dog)
  • A prizewinning animal (like a show dog or blue-ribbon steer) that has provided or could have provided you with significant provable income
  • A rare breed or species (like a type of bird that is close to extinction) which is valuable because of its scarcit.

When a pet dies or gets hurt, the grief and anguish we feel is as real as that we experience when a human is injured or killed. But unfortunately, relief cannot usually be provided by the civil court system.

The Las Vegas region lures gamblers, shoppers, partiers, and show fanatics to the area every year. But this week, another group of people will be descending on southern Nevada: golfers.

Sunday was the official kickoff for the 2010 PGA Shriners Hospitals For Children Open golf tournament and runs through this coming Sunday. The event is taking place at the TPC Summerlin golf course. Pro-am and practice rounds will run through Wednesday, with the four-round competition beginning on Thursday morning. Tee times for each competition round will start around 7am each day.

The arrival of the annual PGA tournament means that there will be a substantial increase in the number of cars, trucks, and SUVs on the road in Summerlin and throughout the Las Vegas area. Much of this increased traffic will be seen in the early morning hours as people rush to get to the event before the first group tees off each day. This could create major traffic jams since the golf traffic may merge with the typical morning rush hour traffic.

Parking for the golf tournament is being hosted by the Suncoast Hotel, which is on Rampart Boulevard just south of Summerlin Parkway. Shuttles will then transport attendees to and from the golf course. As a result, there will be a large amount of pedestrians around the parking area and possible slowdowns due to the large buses on the roads.

So if you are driving around west Summerlin this week, please exercise extra caution in order to avoid accidents and collisions with pedestrians. If you do get hurt in an car accident or are struck by a vehicle while walking, seek medical attention and then contact a personal injury attorney to see about seeking compensation for your injuries.
