Readers of this blog probably remember the tragedy involving a 42-year old woman who died after a botched cosmetic surgery procedure in Las Vegas back in April. The victim went to the back of a tile shop to receive injections into her buttocks, but she died hours later from an allergic reaction to the anesthesia that was used in the procedure. Police arrested a Colombian couple who administered the treatment and charged them with murder.

Today, Ruben Matallana-Galvas and Carmen Torres-Sanchez accepted a deal offered by prosecutors and pled guilty to lesser charges. The husband and wife will be sentenced in October on charges of conspiracy, manslaughter, and practicing medicine without a license. The two Colombian nationals insist that the woman’s death was an accident. But many of the woman’s family members were in the courtroom trying to urge the prosecutors to try the couple for murder.

However, the fact that Matallana-Galvas and Torres-Sanchez will be convicted of crimes is significant, because it strengthens any wrongful death lawsuit that may be filed by the victim’s family members. Because the crimes indicate that the Colombians were responsible for the woman’s death, they are more likely to be held liable for damages in a civil case. These damages may include burial costs, lost future wages that would have been earned by the woman, loss of care and companionship for the victim’s children, and pain and suffering for the rest of the woman’s family. (Since neither the man nor his wife were licensed medical professionals, they will not be sued under medical malpractice statutes).

Readers of this blog may recall the tragic story about a southwest valley auto accident which killed a Brazilian woman and injured three other people. The wreck was apparently caused by a 21-year old Las Vegas resident who ran a red light at the intersection of Jones Boulevard and Harmon Avenue last Wednesday evening. Now, there are reports that the red-light runner was intoxicated at the time of the crash – and it wasn’t her first time.

After last week’s deadly collision, Metro Police gave the 21-year old a blood test to determine if she had alcohol in her system. But police records indicate that the woman was arrested for DUI back on May 22, posted bail, and was released, with her arraignment date scheduled for later this month. Toxicology results have not yet been received in connection with last week’s incident.

However, if evidence indicates that the 21-year old was driving drunk both in May and last week, it could have serious repercussions for any wrongful death lawsuit that may be filed by the family of the 51-year old (a mother of three young daughters) who perished in the crash. This fact would have a similar impact on any personal injury lawsuits filed by the 50-year old Brazilian woman and the 40-year old California woman who were also in the vehicle with the decedent (as well as for the 26-year old male passenger in the car alongside the 21-year old). A second DUI might increase the odds that all of these lawsuits might involve punitive damages being leveled against the defendant, since a case could be made that she didn’t change her behavior after receiving her initial DUI.

Residents of Las Vegas and Clark County should never hesitate to contact an auto accident attorney if they have been injured in a motor vehicle collision in the valley. But that advice also applies to tourists and other visitors to the area from out of state – or even out of country.

You may have heard about the auto accident yesterday in the southwest valley that claimed the life of a woman from Brazil. According to witnesses, a Ford Focus carrying two Las Vegas residents ran a red light at the intersection of Jones Boulevard and Harmon Avenue Wednesday evening. The car slammed into another Ford Focus and killed its driver, a 51-year old Brazilian woman. Her two female passengers, a 50-year old Brazilian woman and a 40-year old from Oakland, California, were also hurt. The 21-year old driver of the alleged red light-running vehicle sustained minor injuries, but her 26-year old male passenger was taken to a hospital in serious condition.

If the ongoing police investigation confirms the witness accounts of the accident, the Focus driver from Las Vegas may eventually be served as the defendant in a wrongful death lawsuit by the victim’s family members and in personal injury lawsuits filed by the other two female victims and/or the male passenger in her car. Readers of this blog know how dangerous trucking accidents can be. The size and weight of tractor-trailers increase the potential for both property damage and injuries when they collide with other vehicles. But what often gets overlooked is that most of these trucking accidents (about 56%, according to AAA) are caused by other motorists who don’t exercise adequate safety measures when driving near big rigs.

That’s the impetus of an initiative taking place in the valley through Thursday. Nevada Highway Patrol officers will be riding along in some “decoy trucks” on I-15, U.S. 95, and other roadways in and around Las Vegas in an effort to spot motorists who are driving recklessly around tractor-trailers. This is the second time that the “Badge on Board” program, which pairs NHP with both the National Highway Traffic Safety Administration and the Federal Motor Carrier Safety Administration, has implemented this type of sweep.

Officers will specifically be looking for drivers who speed past trucks, follow tractor-trailers too closely, or cut too closely in front of trucks when passing them. They will be issuing citations in an effort to raise awareness about this issue. According to the NHP, seven out of ten people injured in tractor-trailer accidents are occupants of passenger vehicles.

Some people claim that the level of blood alcohol content for a driver to be considered legally intoxicated (.08) is too low in Nevada. But studies have shown that a driver’s reflexes begin to get slower even when the BAC is well below the legal limit. And it’s hard to imagine a person getting behind the wheel of a vehicle when his or her BAC is twice the legal limit – much less almost four times the legislated level of intoxication.

But there was such a case which was heard by the Nevada Supreme Court last week. The court upheld the DUI conviction of Vickie Duran, who was found guilty of DUI after her blood alcohol content was discovered to be an amazing .315. That’s the equivalent of a 140-pound person consuming ten drinks in a single hour.

The case centered around a fatal accident in October of 2009 in Las Vegas. A Honda Accord driven by a 38-year old woman had just turned left onto Nellis Boulevard from New World Avenue (a few blocks south of East Wyoming Avenue) when Duran’s Toyota Sequoia rear-ended the car and pushed it across the roadway. A ten-month old boy in the Honda was killed in the crash. Duran fled the scene in her SUV (which also had a nine-year old boy inside), but was arrested a short time later when she couldn’t get her vehicle started again after pulling into a parking lot.

A subsequent criminal trial found Duran guilty of driving under the influence, child endangerment, and leaving the scene of an accident. She was sentenced to between eight and 20 years in prison. The appeal centered on whether the accident was caused by the 38-year old driving too slow and recklessly. But the court rejected that argument.

The Honda driver certainly has solid grounds for a wrongful death lawsuit against Duran. The mother of the toddler would probably be eligible for compensation for medical costs, burial expenses, lost future wages, and even pain and suffering-related damages.

Fatal Accident in East Las Vegas

Generally speaking, traffic moves pretty smoothly on Las Vegas roads, highways, and freeways because they are well-marked and regulated. Intersections are controlled by traffic lights or signs, while freeways and interstates have exit and entrance ramps to facilitate the flow of traffic. But where problems arise is in situations where there are no visible indicators of what drivers should do – like with parking lot driveways. Sometimes, this confusion can lead to tragedy.

Metro Police are still trying to sort out what happened in east Las Vegas where a woman was killed in a fatal accident. Last Thursday around 7am, the woman was behind the wheel of a 2000 Mazda Protégé and was trying to exit the parking lot of a Food 4 Less store on East Bonanza Road. She turned left and entered the middle lane of traffic, but was struck on the driver’s side by a 2007 Ford Econoline van. The victim sustained critical injuries and later died at University Medical Center. The van’s driver and occupants were treated for minor injuries at the same facility.

Police have not yet issued any citations in connection with the incident, and authorities are still investigating the fatal accident. From the news story, it is difficult to determine who was at fault in the collision. Did the woman fail to yield the right of way to the van before turning left onto the roadway? Or was the van driver negligent in avoiding the Mazda when it was in the middle lane? These questions will have to be answered before culpability is assigned – which may affect the likelihood of success for any subsequent wrongful death lawsuit filed by the woman’s heirs.

Nevadans Pay High Auto Repair Costs

If you live in Las Vegas or Clark County, you’ve probably had to suffer the ordeal of getting your car repaired. Perhaps you may have even experienced some consternation when you received the total bill. You might have wondered, “Are car repairs this expensive everywhere?”

Maybe not.

CarMD.com reports that according to its 2010 Vehicle Health Index, Nevada is the fifth costliest state in America for auto repairs (behind Arizona, New Mexico, Colorado, and California). On average, Nevadans pay almost $394 to get their vehicles fixed - which is about 11% higher than the national average. The study looked at repairs which were requested after a vehicle’s “Check Engine” light appeared on the dashboard.

CarMD.com explains this phenomenon by noting that Nevadans drive more miles than motorists in other states because cities are further apart and mass transit isn’t as prevalent. Also, car repairs caused by the heat and dusty air may take more time to fix (resulting in higher labor costs).

You can bet that insurance companies are looking at this data. And they may assume that any car repairs, whether from “Check Engine” lights or from auto accidents, will cost more than the “industry average.” As a result, they might be more obstinate in providing reimbursement for all of the costs you incurred from an accident – whether they relate to auto repairs or medical expenses due to injuries.

This week, a Las Vegas tourist website posted a story about the newest trend in Sin City: Vegas pool parties. Whereas swimming pools on hotel or casino properties used to be places where guests spent lazy afternoons, they have now become the hottest places to drink, party, and be seen.

Today, it’s not uncommon to see a long line of young adults in bathing suits, makeup, and perfect hair waiting to pay $100 each to get into a Strip property’s pool area – at 7am in the morning! Once they get in, they plunk down more money for drinks (and sometimes food) and either crowd their way into the pool or find a small piece of real estate on which to sit or lie. A few will rent cabanas and spend hundreds or even thousands of dollars entertaining their “friends.” It’s like someone transported the clientele from the dance clubs to the swimming areas.

So far, places like Hard Rock, MGM Grand, the Palms, and Mirage have embraced the trend and reaped substantial monetary benefits as a result. But what will happen if/when the first serious accident occurs at a pool party and a lawsuit is filed?

Think it won’t happen? Don’t bet on it. Just imagine all of the accidents that occur at regular swimming pools and combine them with the types of problems found in nightclubs across the city. Someone could easily…

• slip on wet concrete and hit their head
• loses consciousness after drinking too much alcohol out in the sun
• pass out from drinking and sustain a second-degree sunburn
• sustain a serious injury as the result of a fight
• lose consciousness in the pool and drown before anyone notices

If a patron were to die as the result of a pool party accident, the hotel property could be targeted by a wrongful death lawsuit for being negligent in its duty to protect its guests. That could conceivably result in a very large settlement or damage award to the family members of the victim.

You have to think that it’s only a matter of time before tragedy strikes at a Vegas pool party. What will happen to the trend then?

The Independence Day holiday weekend is almost upon us. That means barbecues, picnics, and fireworks shows across Clark County. Most people will probably celebrate the birth of our nation responsibly, but there are bound to be a few who endanger everyone else by trying to drive while under the influence of alcohol or drugs.

To that end, Metro Police is setting up DUI checkpoints at certain spots across the valley. Two of those checkpoint locations have already been announced.

Beginning Friday evening at 7pm, law enforcement officers will be set up in the northwest part of the valley at Charleston Boulevard and Community College Drive. That checkpoint will remain operational until 3am Saturday morning. According to authorities, there have been 14 arrests for DUI, 31 motor vehicle collisions, and 67 drug- or alcohol-related incidents at or near that intersection since the start of the year.

Another DUI checkpoint will be in place later in the weekend near the Strip on Paradise Road a bit north of Tropicana Avenue. Police will operate this checkpoint from 7pm Sunday evening until 3am on the morning of July 4th. Officials say that because this second checkpoint will concentrate on identifying drugged drivers, Drug Recognition Expert Officers will be on hand to evaluate motorists.

Metro officers will be joined at these checkpoints by members of the Henderson and North Las Vegas police departments, as well as personnel from the Lincoln County Sheriff’s Office and the Nevada Highway Patrol. These DUI crackdowns are being funded in part by a Joining Forces grant provided by the Nevada DPS’s Office of Traffic Safety.
