Almost all motor vehicle collisions are scary. But perhaps the most terrifying type is the wrong-way accident – especially if it occurs at night. Just imagine that you are driving along on a dark highway trying to stay on the road, when suddenly two headlights leap out in front of you from the darkness. Because these collisions are so unexpected, the consequences can be devastating.

That’s what happened to a 31-year old Henderson woman this past weekend on U.S. 95. Around 3am on Sunday morning, a Toyota Scion driven by a 25-year old Wisconsin native was traveling north in the southbound lanes of the highway near College Drive in Henderson when it struck the woman’s Toyota Sequoia. She was rushed to Sunrise Hospital and Medical Center with serious injuries. The male driver of the Scion, who was not wearing a seat belt, died at the scene.

The accident is still under investigation by the Nevada Highway Patrol, and news articles do not indicate how or why the Scion crossed into oncoming traffic. But it is not uncommon for people to become confused while driving alone at night. So it is important to watch for telltale signs that you are driving on the wrong side of the road. These include:

  • Headlights off to your right that are facing you
  • Street or road signs that are facing away from you
  • Red reflectors on the road’s lane markers

If you have been hurt in a wrong-way accident, be sure to contact a qualified auto accident attorney to fight for any compensation that you are entitled to.

Recently, a 74-year-old man was hit by a car on Boudler Highway near Dalhart Street in east Las Vegas near the Great Basin Highway. According to police reports, the bike rider tried to turn left across traffic when a Hyundai Elantra that was in the right lane at the time struck the bike rider.

The bike rider was transported to Sunrise Trauma Center with critical injuries. The driver of the car, a 66-year-old Henderson resident was uninjured. The bicycle accident remains under investigation; but so far, the driver has not been charged with any crime.

Bike riders are permitted to ride on the shoulder of a highway (in fact, unless otherwise marked they are allowed in regular traffic lanes as well).

If you have any questions about a bike accident in which you were involved, contact a qualified bike accident attorney for assistance.

Recently, a 50-year old man was standing near a Las Vegas bus stop on a sidewalk just south of McCarran Airport. According to witnesses, a sport utility vehicle (SUV) tried to turn left from South Paradise Road to East Sunset Road.

However, the driver, a 29-year old California woman, lost control on the rain-slicked street, jumped the curb, struck the man, and pinned him to a tree. The unidentified victim, who was conscious while emergency crews freed him, later died from his injuries at a hospital.

Police have not yet decided whether to file criminal charges against the driver but it appears that the family of the victim may have grounds for a wrongful death lawsuit against the California woman.

For some, this pedestrian death illustrates the most frightening scenario possible: becoming the victim of a random fatal car accident while doing nothing but minding your own business.

Law enforcement agencies stepped up their efforts to apprehend drunk drivers in Las Vegas and Clark County over the long Labor Day weekend.  A total of 45 drunk driving arrests were made in southern Nevada during the holiday weekend, according to the Las Vegas Sun. The National Highway Traffic Safety Administration says that Labor Day weekend is the second deadliest holiday for motorists across the country.

This increase in enforcement was highlighted by four sobriety checkpoints which were set up for an eight-hour period spanning Saturday night and early Sunday morning. Two of them were in Las Vegas proper, one was in North Las Vegas, and the fourth was manned in Henderson. Several police agencies also beefed up standard patrols in areas where drunk drivers were likely to be found.

This is all good news for Clark County drivers and residents. But the bad news is that police agencies do not have enough resources to maintain this level of vigilance against drunk drivers throughout the entire year. So that means that the chances of an intoxicated driver injuring or killing you or someone you love have increased now that the Labor Day weekend is behind us.

While law enforcement agencies are responsible for catching drunk drivers and the courts can levy fines or jail sentences, accident victims need a lawyer to fight for compensation for their injuries, lost time at work, and any pain and suffering they have endured. So if a drunk driver has caused an accident in which you or a family member was injured, you should contact a drunk driving lawyer after you have received the proper medical attention.

Drinking too much in the privacy of your own home is not against the law, but when people consume too much alcohol and get behind the wheel, they are putting everyone else around them in danger. All too often, drunk drivers get into car accidents leading to serious injuries or loss of life.

Drunk driving accidents can happen anywhere – from Green Valley sidestreets and Las Vegas freeways to Henderson thoroughfares and unpaved roads in Clark County. DUI offenders face stiff penalties including fines, incarceration, and license suspensions – but that doesn’t mean much to the innocent victim who was hurt in the accident.

If you are involved in a car crash caused by a drunk driver, the first thing you should do is get the proper medical attention. However, if you are able to function without worsening your injuries, or if another occupant in your vehicle is unhurt, there are some steps that can be taken to bolster a future personal injury claim against the drunk driver.

  • Watch the suspect. Note what he or she says and does before authorities arrive. Look for signs of intoxication such as slurred speech, a stench of alcohol, or a severe lack of balance.
  • Find witnesses. Get the statements and contact information of people who saw the accident happen. Remember that there could be witnesses watching from windows of buildings.
  • Take photos. Even if you just have a camera phone, you can photograph the accident site, your vehicles, and any non-auto related damage (like crushed garbage cans or knocked over signs). You should also photodocument your injuries starting from the time you sustain them and then periodically until they are healed.

Then take all this data to your initial consultation with your personal injury attorney. It will help persuade a jury that you deserve compensation for the toll a drunk driver has taken on your life.

The answer to this query depends on certain factors.

There is a legal term known as vicarious liability, which basically means that because of your parent-child relationship, blame for your child’s actions can be passed on to you. Here are some examples of when vicarious ability applies to parents.

  • If you tell your child to harm or cause pain to someone else (like yelling at your teenage son to punch an opposing player on a Henderson soccer field).
  • If you give a dangerous item (like a pistol, book of matches, or hand saw) to your child, and it’s obvious that he or she is too young, unskilled, or uninformed to appreciate its dangers, and he or she injures someone else with that item (like giving an icepick to your 18-month old daughter who takes it to a Pahrump daycare center and stabs another toddler with it).
  • If you let your child perform a task or participate in an activity, and it’s obvious that he or she is too young, unskilled, or uninformed to appreciate its dangers, and he or she proceeds to injure someone else (like letting your eight-year old son drive your pickup truck on a Clark County road, and he runs over an elderly woman crossing the roadway).
  • If you have knowledge of your child’s previous dangerous behavior, but still put him or her in a similar situation and he or she injures someone else (like leaving your 12-year old daughter, who has been diagnosed with pyromania, in your elderly neighbor’s house with the fire burning in the fireplace – and she sets the house on fire, killing the neighbor).

On the other hand, if you think that someone else’s child is responsible for injuries to you or someone you love, and that the parents are ultimately responsible, be sure to contact a personal injury attorney immediately.

If you trip and fall in a public place or private building, there are many different types of injuries that you can sustain. But one part of your body that you may not associate with slip and fall accidents is your rotator cuff.

If you follow athletics, you may have heard about competitors injuring their rotator cuff while playing sports such as baseball, tennis, bowling, or golf. The rotator cuff is defined as the group of tendons and muscles which attach your shoulder blade to your upper arm. When functioning properly, the rotator cuff gives your shoulder more range of movement than any other joint throughout the body.

But when your rotator cuff is strained or torn, you can not only see decreased range of motion but also feel substantial pain in your shoulder. Serious rotator cuff injuries may require physical therapy, steroid injections, or even surgery.

And when it comes to slip and fall accidents, rotator cuff injuries are more common than you think. When people start to lose their balance, their instinct is often either to grab for a nearby rail or support or to put their arm down to brace their fall. Either action can lead to an awkward strain on your shoulder and result in a rotator cuff injury.

You could potentially injure your rotator cuff in a fall caused by:

  • Wet supermarket floor in Henderson
  • Poor lighting in a Green Valley movie theatre
  • Broken concrete on a walkway outside a Summerlin apartment building
  • Torn carpeting in a Las Vegas casino
  • Broken or absent handrails in a stairwell of a Boulder City office building

In addition to constant pain, symptoms of a rotator cuff injury include an inability to lift heavy objects, reach above your head, put weight on your shoulder, or even carry out daily activities like dressing yourself or combing your hair. If you suspect that you have a rotator cuff injury that was caused by a slip and fall accident, consider contacting a qualified personal injury attorney.

When people are involved in a car accident, they are usually not thinking clearly. They may feel injured, frightened, or ashamed. As a result, they may say or do things that are counterproductive or are not in their best interests.

Whether you have been rear-ended in Henderson, sideswiped in Summerlin, or plowed into in Pahrump, here are five common mistakes you need to avoid after being involved in a car accident.

1. Not Getting Medical Care

If you’re not seriously injured, you still need to see a physician to get treatment. Not only will your health suffer if you eschew medical care, but you also won’t be able to collect damages if there’s no official record of your injuries.

2. Not Getting Evidence

You can’t just tell a court or insurance company that you were in a “nasty accident.” You will have to prove that you are entitled to relief and reimbursement. This may mean assembling witness statements, police reports, and photos of your injuries as well as the accident scene.

3.Revealing Too Much to the Insurance Company

Insurance companies may tell you that they need certain information in order to process your claim properly. Sometimes this is true, but sometimes it isn’t. You don’t want to reveal information that can be used against you in court. (Personal injury lawyers can help you navigate this process effectively.)

4. Settling Claims Too Quickly With Insurance Companies

You may be tempted to sign something just to get a quick check and put the whole ordeal behind you. Don’t do it. Insurance companies survive by paying out the smallest amount of money they can on any given claim. Often, the settlement amount may not be sufficient given the facts of your case – and you can’t ask for more money after the claim has been settled.

5. Not Collecting From Everyone Involved

You may think that the only entity you have to deal with is the other driver’s insurance company. But you may also have a claim against the driver’s employer, other motorists who were involved in the accident, or even the property or municipality where the accident occurred. A personal injury lawyer will be able to help you determine this as well.

Whenever you’re in an accident, it is wise to contact a personal injury lawyer. They can assist you in getting reimbursements for medical costs and other compensation to which you are entitled.

Maybe you’re looking forward to getting a manicure. You could stop by a strip shopping center in Henderson, or a spa in Boulder City, or a kitschy salon just off the Strip in Las Vegas.

You probably haven’t stopped to think about suffering nerve damage.

manicure, injury, nerve, damage, lawyer, attorney, Las VegasUnfortunately, it is a legit risk. Manicures known as “gel manicures” have been linked to nerve damage in some women. Patrons getting gel manicures get their nails sanded down with a vibrating electric file, then painted with a “gel” mixture which is solidified when the nails are heated under an ultraviolet lamp.

But when the rough sanding of the nails also scrapes away skin layers on the fingertips, the fingers become vulnerable to toxic chemicals in the polish mixture. While true “gels” are made of benign materials and are therefore not dangerous, some salons use mixtures that are made of harmful glues, powders, or acrylics which are marketed as gels.

These mixtures may contain ethyl methacrylate or methyl methacrylate, both of which have been linked to nail damage and deformity as well as contact dermatitis. So if these substances penetrate your skin, the nerves in your fingers could be damaged permanently.

If the so-called gels are in unmarked containers, or if your manicurist cannot tell you the ingredients in them, then you should be wary of them being applied to your nails. Also, if the gels don’t soak off easily in solvents which are supposed to remove acrylics, or you experience any swelling, redness, or other signs of infection, there may be an unsafe substance in your nail polish.

If you feel that you may have suffered nerve damage as a result of a gel manicure, seek medical attention and then contact a personal injury lawyer.

It is common to suffer bruises, lacerations, or even broken bones in an accident. As a rule, these injuries usually heal over a period of time. But if you sustain nerve damage, your health could be affected for a very long time – or possibly even permanently.

You could slip and fall in a Henderson grocery store. Displays, merchandise, or other items can fall on you at a big box store in Summerlin. A mugger could physically assault you while you jogged through a Clark County park. Or you could get rear-ended by another driver on the strip in Las Vegas.

nerve, damage, paralysis, accident, injuryAll of these accidents can result in nerve damage, which is also called peripheral neuropathy. If you think you may have sustained nerve damage in an accident, seek medical help immediately. You should then consult with an injury lawyer.

Think of the human body as an electrical grid, with the nerves being the electrical wires through which messages are transported to and from the brain. If a blockage were to occur somewhere along this “network,” it may affect the entire body as well as the point of the obstruction. This is why nerve damage can be so serious.

If nerves are stretched or pressured, they can usually heal once the source of the problem is eliminated. But if nerves are cut, they must be fixed surgically. If the nerve damage cannot be repaired, the area of the body where it occurs is subject to paralysis because the brain’s signals are unable to travel to it. If the nerve damage is in the spinal cord or brain, most or all of the body can become paralyzed permanently. The cost of care for paraylsis can reach the millions over a lifetime. You may require 24 hour care, depending on the extent of the paralysis. Again, this is why you should contact a qualified personal injury lawyer. We will fight to get the compensation you need to cover those large medical bills along with lost wages and reimbursement for pain and suffering.
