As you drive along highways and interstates in and around Las Vegas, you probably notice areas in the median that appear to allow passage over to the other direction of traffic. But these areas are usually designated only for emergency personnel, not civilian vehicles – because slowing or stopping to turn left into a median in the “fast lane” of highway traffic can easily cause a serious accident.

That’s what happened on Interstate 15 last week near Moapa. Around 7am Wednesday morning, a tour bus carrying Chinese tourists inexplicably tried to make an illegal U-turn in the median of the interstate near mile marker 97. Behind the bus, a Chevy Camaro was traveling at a high rate of speed in the left lane and was unable to avoid a collision with the bus. The crash destroyed most of the car’s front end and injured several passengers on the bus.

As it turned out, the driver of the Camaro is the reigning Ms. Nevada. She was transported to University Medical Center with critical injuries. She was preparing to participate in the Ms. United States pageant in Las Vegas in July.

Since the accident was caused by the tour bus making an illegal U-turn on the interstate, the Camaro driver appears to have a solid case for a personal injury lawsuit against the bus driver – and, by extension, the tour bus company. To make matters worse, it appears that the tour bus company was not legally permitted to operate by the U.S. Department of Transportation at the time of the crash. Southern Nevada has a reputation of having triple-digit temperatures… but not during late September.

On September 28, Las Vegas’s McCarran International Airport tied a record high temperature of 103 degrees for that date (the high mark was set back in 1978). And the mercury is expected to remain at record or near-record levels for the rest of the week.

Because people in Las Vegas are used to sizzling temperatures, we know how to take precautions against sunburn, heatstroke, and other related maladies. But that doesn’t automatically mean that our children will be protected from them.

Many activities involving children are often planned well in advance, such as:

  • recess activities at schools
  • sports practices

When you file a personal injury lawsuit against another person or company, you will likely be entitled to damages if the defendant was completely at fault in an accident.

But what happens if both parties share blame for an accident?

The state of Nevada has fashioned its negligence laws to accommodate these types of situations. It’s called “comparative negligence.” While the actual legislation is complex, here are its two basic tenets:

  • The party who is more to blame for an accident cannot receive damages from the other party.
  • A plaintiff who shares partial blame for an accident will see his or her damages reduced in proportion to the amount of fault.

For instance, if a man were involved in an accident where he sustained $10,000 worth of property and injury damages but was determined by the courts to be 30 percent at fault, he would only receive $7,000 ($10,000 minus 30 percent of $10,000) in compensation from the defendant.

This situation arises more than you might think. Here are some potential scenarios where an injured party might be partially at fault for an accident.

  • A woman driving without her lights on at dusk is rear-ended on a Las Vegas street.
  • At a Green Valley warehouse store, a man walks into an area clearly marked “Authorized Personnel Only” and is injured when pallets of stored merchandise fall on top of him.
  • A teenager riding a skateboard is struck by a car in a Boulder City parking lot which is clearly marked with signs saying “No Skateboarding Allowed.”

  • Manufacturing plants introduce harmful substances into the soil or water that resulted in someone’s death
  • Drunk drivers with multiple offenses kill a motorist or pedestrian
