Here in the valley, we hear a lot about swimming pool accidents where unsupervised children wander into pools and drown. In many of these cases, an adult who was supposed to have been watching the child is arrested and indicted on criminal charges. This week, a Pahrump man was placed under arrest in connection with a gun accident in his home. On Tuesday, police were called to the home after a 13-year old boy was accidentally shot in the leg by a .22 caliber handgun. The victim had been playing with the weapon along with a 15-year old, who had been given the gun by his father. The 13-year old is expected to recover from his wounds.

When police arrived at the residence, they found several unsecured guns and ammunition inside where the teens had been playing. The father was later charged with child endangerment. His wife, who was actually in the home at the time of the accident, also faces similar charges. The man did own a gun safe, but it’s unclear as to why the weapons were not secured inside it.

This case demonstrates how both the owner of the guns (the father) and a “supervising” adult on-site (the wife) can be held criminally responsible for the teen’s accident. This logic applies in civil court as well. The article does not state whether the victim was related to the adults; but if he isn’t, then the 13-year old’s parents have grounds for a personal injury lawsuit against the man and his wife.

Sometimes, you read about incidents which make you shake your head and ask, “Why?” These types of stories are especially troublesome when someone gets hurt as a result. Unfortunately, one such incident occurred in Pahrump last week.

Authorities are investigating why three men threw a large rock through the windshield of a car at a service station in Pahrump near Blagg Road and Highway 372. A 20-year old woman sitting in the passenger seat suffered severe injuries to her head and had to be airlifted to University Medical Center in Las Vegas.

Perhaps the most troubling aspect of this occurrence is that Thursday evening’s rock-throwing incident appeared to have been planned. And it wasn’t executed by a couple of prank-happy teenagers. Three men are suspected in the attack, and they are still at large. Police have identified the suspects as 23-year old Timothy Michael Hannah, 20-year old Kevin Thomas Hannah, and 23-year old David Neil Taylor. At least one of the men is believed to have fled to Las Vegas or the surrounding area.

No details have been released by authorities regarding a possible motive or any circumstances which may have contributed to the attack. Hopefully, this means that investigators do possess additional information but are not sharing it with the public until the suspects are in custody.

Because Taylor is facing charges including assault with a deadly weapon and the two Hannahs are being sought on accessory charges, this may indicate that officials believe that Taylor was the one who actually threw the rock through the windshield of the vehicle. In addition to criminal charges, the victim would likely be entitled to monetary damages in any future personal injury lawsuit.

People in Clark County, Pahrump, and Summerlin  love to ride their bicycles. The abundance of bike paths and trails coupled with a temperate climate all year long provide an excellent bike-riding environment for people in the Valley. Generally speaking, bike riders and drivers must both obey the laws of the road and also share the roadway (unless it has specifically marked bike lanes). 1. Did the driver’s negligence or recklessness directly result in the accident and injuries sustained by the bike rider?

If the bike rider turned abruptly in front of the vehicle, ran a stop sign, or rode the wrong way on a one-way street, then this could be presented as evidence of the cyclist’s responsibility in causing the accident. If this is the case, the bike rider may be held partially (or fully) liable in the cause of the accident, which may result in reduced damages (or no damages at all) awarded by a court.

  • Sudden withdrawal and/or a hesitation to talk openly
  • Being afraid or uncomfortable around caregivers
  • Denial of injuries or implausible or contradictory statements about them
  • A consistently dirty environment where feces or urine may be constantly present
  • Refusal by the caregiver to let the senior speak for himself or herself
  • Refusal by the caregiver to let you be alone with the senior
  • Anger or ambivalence exhibited toward the senior by the caregiver
  • Differences between the accounts of the injuries given by the caregiver and the senior 

If you notice any of these signs of abuse or neglect, you should notify either the managers of the nursing home facility or the police. If you think that a family member is a victim of senior abuse or negligence, take immediate steps to remove your loved one from the abusive situation. Then a few days after your accident, you get a telephone call from an insurance adjuster.

Unfortunately, this is part of the process of getting the compensation you deserve. But if you handle the conversation with the adjuster poorly, it could have a negative effect your claim. So here are a few suggestions.

Refuse to be recorded on tape. The insurance adjuster will ask you for your permission to make an audio recording of your phone interview. Do not give it. Tell them to get the necessary details from the police report. Putting your comments on tape gives the insurance company an opportunity to use your words against you later.

Provide only the necessary information. Give the adjuster your name and address – and make sure you get the same from them (as well as their phone number and company name). Say when and where the accident took place and give a general description of how you were injured. If the adjuster asks for more details about your injuries, say that the medical report will be sent to them as soon as your health has been fully assessed by a physician.

Do NOT agree to anything! Make sure that your attorney reviews your case first. If the adjuster sends you some paperwork to sign a few days after your phone conversation, do not sign it until you show the documents to your lawyer.

Over one million Americans suffer burn injuries every year. Many times, these injuries are caused by the actions of someone else. A burn occurs when skin tissue is damaged by an external source. Most burns are caused by heat, electricity, chemicals, sunlight, or radiation.

Superficial (or 1st-degree) burns are found when just the outer skin layer is affected. Usually, the burned area heals completely.

But with dermal (or 2nd degree) burns, the second layer of skin (the dermis) receives damage. Scarring is usually present even after the burn heals.

In the case of full-thickness (or 3rd degree) burns, the third layer of skin, which supports fat and subcutaneous tissue, is harmed. Skin grafts are needed to repair the burned skin, and not only will the area remain scarred for life, the skin often ceases to sweat, grow hair, or generate skin cells permanently

The most serious type of burn is a 4th degree burn, which extends all the way through the skin and into underlying tissue. These burns can cause irreversible muscle or ligament damage and can even be life-threatening.
